Welcome to the official website of Nchanga Golf Club ("the Club", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Nchanga Golf Club Website ("Website"), including any content, functionality, and services offered on or through the Website.
By accessing or using the Website, you signify your agreement to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Website. Your continued use of the Website following the posting of changes to these Terms will be deemed your acceptance of those changes.
Club: Refers to Nchanga Golf Club, its management, employees, agents, and authorised representatives.
User/You: Refers to any individual accessing or using the Website, whether as a guest, a registered user, or a member.
Website: The official online presence of Nchanga Golf Club, accessible at https://nchangagolfclub.golf and all associated subdomains.
Content: Includes all text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided, or otherwise made available through the Website.
Member: An individual who has successfully applied for and been granted membership to Nchanga Golf Club in accordance with the Club's constitution and membership policies.
Services: All products, services, features, and functionalities offered through the Website, including but not limited to membership applications, tee time bookings, event registrations, tournament entries, and online payments.
User Content: Any content that you submit, post, upload, or otherwise make available through the Website.
By using the Website, you represent and warrant that you are at least 18 years old or have reached the age of majority in your jurisdiction, and are legally capable of entering into a binding agreement. If you are accessing the Website on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.
Certain features of the Website may require you to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information promptly to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the Website and for any activities or actions under your password.
Existing members of Nchanga Golf Club may have access to a secure member portal with additional features and functionality. You are responsible for maintaining the confidentiality of your member account login information and for all activities that occur under your account.

All other names, logos, product and service names, designs, and slogans on the Website are the trademarks of their respective owners.
The Nchanga Golf Club logo is a registered trademark and is protected by intellectual property laws. Unauthorised use, reproduction, modification, or distribution of the logo is strictly prohibited and may result in legal action. Any use of the Club logo must be approved in writing by the Club management.
If the Website allows for user-generated content (including comments, reviews, forum posts, or photo uploads), you are solely responsible for the content you submit. By submitting content, you grant Nchanga Golf Club a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content throughout the world in any media. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish such content.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial purposes. You may download or print a single copy of any portion of the content for your personal, non-commercial use, provided you do not remove any copyright or other proprietary notices. This license does not permit you to: modify, reproduce, distribute, or publicly display any content without our prior written consent; use the content for any commercial purpose; or use any data mining or similar data gathering and extraction methods.
All tee time bookings made through the Website are subject to availability and the Club's booking policies. The Club reserves the right to cancel or reschedule tee times due to course conditions, weather, or other operational requirements. Members and guests are expected to adhere to the Club's dress code, pace of play guidelines, and code of conduct while on the course.
Applications for membership are processed through the Website. Submission of an application does not guarantee membership. All applications are subject to the Club's membership approval process, which may include a review by the membership committee, payment of applicable fees, and acceptance of the Club's constitution and rules. Membership is granted at the sole discretion of the Club.
Membership fees are set by the Club and are subject to change with reasonable notice to members. All fees are non-refundable unless otherwise stated in the Club's official membership policy or as required by applicable law. Members are responsible for paying all fees by the due dates specified.
All participants in tournaments and competitions organised by Nchanga Golf Club must adhere to the official Rules of Golf as published by the R&A Rules Limited and any specific tournament rules or conditions of competition published by the Club. The Club reserves the right to disqualify any participant for breach of rules or code of conduct.
Bookings for events, corporate days, weddings, and other functions are subject to specific terms and conditions provided at the time of booking. A deposit may be required to secure the booking, and cancellation policies will apply as specified in the booking agreement.
Registrations for the Junior Golf Programme and other academy programmes are subject to the Club's programme terms and conditions, including age requirements, medical clearance, and parental consent where applicable.
Online payments for membership fees, event registrations, bookings, merchandise, and other services are processed securely through third-party payment gateways. We do not store your full payment card details. By making an online payment, you authorise the Club to charge the specified amount to your chosen payment method.
All prices displayed on the Website are in Zambian Kwacha (ZMW/K) unless otherwise stated. The Club reserves the right to modify prices at any time without prior notice. Prices displayed at the time of purchase shall apply to that transaction.
Refunds for services, bookings, or membership fees are subject to the Club's specific refund policy applicable at the time of purchase or application. Generally, refunds may be considered in the following circumstances: cancellation of an event by the Club, overpayment, or as otherwise required by applicable consumer protection laws. Processing fees may be deducted from refunds where applicable.
Cancellation of bookings, registrations, or orders may be subject to cancellation fees as specified at the time of booking. Tee time cancellations should be made at least 24 hours in advance to avoid charges. Event registrations may have specific cancellation windows as communicated at the time of registration.
In the event of adverse weather conditions that render the course unplayable or unsafe, the Club reserves the right to cancel or postpone events, tee times, or other activities for safety reasons. In such cases, the Club will endeavour to reschedule or provide refunds at its discretion.
Nchanga Golf Club shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, pandemic, or failure of critical infrastructure.
We strive to ensure that the Website is available 24 hours a day, seven days a week; however, we do not guarantee uninterrupted availability. The Website may be temporarily unavailable for scheduled maintenance, upgrades, or due to circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Website at any time without notice.
The Website may contain links to third-party websites or services that are not owned or controlled by Nchanga Golf Club. We do not endorse and are not responsible for the content, privacy policies, or practices of any third-party websites or services. You access such third-party websites or services at your own risk.
The Website and all content, materials, information, software, products, and services included on or otherwise made available to you through the Website are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, in no event shall Nchanga Golf Club, its affiliates, subsidiaries, directors, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: your use or inability to use the Website; any content obtained from the Website; unauthorised access to or alteration of your transmissions or data; statements or conduct of any third party on the Website; or any other matter relating to the Website.
Our total liability to you for any claim arising out of or relating to these Terms or the Website shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the liability, or ZMW 1,000, whichever is greater.
You agree to indemnify, defend, and hold harmless Nchanga Golf Club, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and legal costs) that such parties may incur as a result of or arising from: your violation of these Terms; your use of the Website; your violation of any rights of another person or entity; or your user content.
We may terminate or suspend your access to all or part of the Website, including any user account or member account, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Cause for termination shall include, but not be limited to: breaches or violations of these Terms or other incorporated agreements; requests by law enforcement or other government agencies; discontinuance or material modification to the Website; unexpected technical or security issues; or engagement by you in fraudulent or illegal activities.
Upon termination, your right to use the Website will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law provisions. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.
Before initiating any formal dispute resolution process, you agree to first attempt to resolve any dispute, controversy, or claim arising out of or relating to these Terms informally by contacting us. Both parties will make good faith efforts to resolve the dispute through negotiation.
Any dispute, controversy, or claim arising out of or relating to these Terms that cannot be resolved informally shall be finally settled by arbitration in accordance with the provisions of the Arbitration Act of Zambia, 2000. The seat of arbitration shall be Lusaka, Zambia. The language of the arbitration shall be English. The arbitration shall be conducted by a single arbitrator appointed by agreement of the parties or, failing agreement, appointed by the Zambia Association of Arbitration.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to protect its intellectual property rights or to address claims of unauthorised access or use of the Website.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Website after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Website.
If any provision, or part of a provision, of these Terms is found to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision shall be deemed severed from these Terms without affecting the validity or enforceability of any other provision.
These Terms, together with the Privacy Policy, Cookie Policy, and any other legal notices or policies published by us on the Website, constitute the entire agreement between you and Nchanga Golf Club concerning the Website and supersede all prior or contemporaneous understandings, communications, and agreements, whether oral or written, regarding the subject matter hereof.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. The failure of Nchanga Golf Club to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
